1. Identification

The SVCARD.fr site is the property of the company BANDIT BANDIT whose head office is located at 33 rue Pergolèse 75116 Paris, France, in its entirety, as well as all related rights.

Any reproduction, complete or partial, is systematically submitted to the authorization of the owners. However, hypertext links to the site are allowed without specific requests.

2. Acceptance of the conditions

The customer acknowledges having read, at the time of placing the order, the special conditions of sale set out on this screen and expressly declares to accept them without reservation.

The present general conditions of sale govern the contractual relations between svcard.fr and its customer, the two parts accepting them without reserve. These general terms and conditions of sale shall prevail over any other terms and conditions contained in any other document, unless previously waived in writing.

3. Control

If the customer wishes to place an order, he/she must first identify himself/herself. To this end, he will fill in, according to the indications provided online, a form made available to him where he will provide the information necessary for his identification and in particular his name, first name, telephone number, postal and electronic address and billing and delivery address. All information is presented to the customer in French.

The customer having chosen the products presented, will definitively validate his order by clicking on the button “Validate the order” to manifest his commitment and his acceptance of the General Conditions of Sale. From this moment, the order is recorded, and an order number is communicated to the customer as well as a confirmation on the screen and/or by e-mail. The data recorded by constitute proof of the nature, content and date of the order.

When you place your order, we inform you of the availability of the products you wish to purchase.

Nevertheless, if despite our vigilance, a product proves to be temporarily unavailable after your order, in this case, BANDIT BANDIT will inform you by e-mail or telephone as soon as possible (within five days at the latest) and will invite you to cancel or modify your order. The data recorded by svcard.fr constitute the proof of the order. The data recorded by the payment system constitutes proof of the financial transactions.

The final validation of the order occurs after the validation and acceptance of your payment.

Upon acceptance of your order, svcard.fr will send you an email summarizing the products ordered as well as the delivery information.

4. Price

The prices of our products are indicated in euros, all taxes included, excluding shipping costs.

This price includes the price of the products, the handling and packaging costs of the products.

SVCARD reserves the right to change prices at any time without notice.

5.payment

The payment of the totality of the order must be realized at the time of the order by the purchaser. At no time, the sums paid can be considered as a deposit or advance payment. All orders are payable in EURO. To pay for his order, the buyer has all the means of payment referred to in the order form: credit card or Paypal.

The purchaser guarantees to svcard.fr that he has the authorizations possibly necessary to use the method of payment which he will have chosen, at the time of the recording of the purchase order svcard.fr reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum which would be due by the purchaser, or in the event of incident of payment.

Any delay in payment will automatically entail, for the benefit of our company, a late payment penalty equal to one and a half times the legal interest rate in force on the due date, increased by three points. In accordance with the law since 01/01/2013, in case of late payment, application of a penalty equal to twice the rate of interest in force to which is added a fixed indemnity for recovery costs. Pursuant to Section 121-II of Act No. 2012-387 of March 22, 2012. This allowance is set at €40 by Decree No. 2012-1115 of October 2, 2012. The delivery of any new order may be suspended in case of late payment of a previous order, notwithstanding the provisions hereof.

Reservation of ownership

The delivered goods remain the property of the seller until full payment of their price. The delivery of bills of exchange or securities creating an obligation to pay does not constitute payment.

Notwithstanding the retention of title, the Buyer shall bear the risk of loss or destruction occurring between delivery of the goods and full payment of the price.

6. Methods of payment

The payment of an order can be made :

The validation of the order by credit card is a mandate to pay the price including all taxes of the order. Thanks to the Mollie protocol, the customer will be able to securely transmit the type of card (Carte Bleue, Visa, Eurocard, Mastercard), the card number, the date of validity and the name of the cardholder (name appearing as it does on the card). Online, SVCARD.fr allows you to pay via Mollie’s secure bank server in a secure environment.

Your credit card number is directed to Mollie’s servers, which transmit your payment to our bank in a secure environment without passing through the store’s server, a guarantee that is all the more important as your numbers are known only to our banking partner.

7. Delivery

svcard.fr commits itself to ship within 5 working days any product in stock after acceptance of your payment.

The delivery time is usually 24/48h.

Delivery charges are calculated according to the selected carrier.

These prices include packaging, handling and postage.

For all international shipments. A personalized estimate will then be proposed to you.

Under no circumstances can delays in delivery due to product shortages give rise to compensation and/or damages.

The shipping costs may contain a fixed part and a variable part depending on the price or weight of your order. We advise you to group your purchases in a single order. We cannot group two distinct orders and you will be charged for each one.

Our contracts with our carriers do not allow us to ship to the French Overseas Departments and Territories for the moment.

In case of force majeure or exceptional events (natural disasters, epidemics, strikes, lockouts, etc.) delaying or prohibiting the delivery of goods, BANDIT BANDIT is released from any responsibility.

BANDIT BANDIT is in no way responsible for the non-respect of delivery times announced by the carrier itself. Also, no compensation or refund can be requested from BANDIT BANDIT in case of delay due to the sole failure of the carrier.

Your package is shipped at your own risk, but special care is taken with fragile items.

Boxes are properly sized and your items are properly protected.

8. Withdrawal and complaints

Your order contains a defective product or an item not ordered?

Please contact us directly by email at info@svcard.fr and explain the situation.

An RMA number will be given to you to return your defective products.

Upon receipt of your order in our premises, a new replacement package will be shipped to you at our expense as well.

Products customized with information provided by you will not be refunded

9. Transaction security

Our site svcard.fr uses the secure payment module Mollie.

10. Warranty

All the Products on sale on the Website benefit from the legal guarantee of conformity (L211-1 and following of the Code of Consumption) and the guarantee against hidden defects (articles 1641 and following of the Civil Code), allowing the User to return the defective or non-conforming Products delivered.

– Article L211-4 of the Consumer Code: The seller is required to deliver a good in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.

– Article L211-5 of the Consumer Code: To be in conformity with the contract, the good must :

1) Be fit for the purpose ordinarily expected of similar property and, where applicable :

Correspond to the description given by the seller and have the qualities that he presented to the buyer in the form of a sample or model

Have the qualities that a purchaser may legitimately expect, having regard to the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;

2) Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

–Article L211-12 of the Consumer Code: The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good.

– Article 1641 of the Civil Code: The seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lower price, if he had known about them.

– Article 1648 al 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

The customer has a period of 14 days from the date of delivery to make any reservations or claims for non-conformity or apparent defects of the items delivered, by e-mail via the contact form; or by registered mail with acknowledgement of receipt to the following address BANDIT BANDIT – Customer Service, 30 rue Carle Hébert 92 400 COURBEVOIE.

After this period and in the absence of compliance with this formality, the articles shall be deemed to be in conformity and free of any apparent defect and no claim shall be validly accepted by BANDIT BANDIT.

If the apparent defect or lack of conformity of the article is proven, BANDIT BANDIT undertakes to replace the article or to reimburse the customer as soon as possible and at its own expense.

This refund will be made within a maximum of 30 days.

BANDIT BANDIT shall not be held responsible for the misuse and/or intensive use of the articles by the customer.

11. Intellectual Property

All texts, comments, works, illustrations and images reproduced on svcard.fr are reserved under copyright law as well as under intellectual property law and for the whole world. In this respect and in accordance with the provisions of the intellectual property code, only private use is authorized, subject to different, even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the svcard.fr site is strictly forbidden without prior agreement.

12. Personal, nominative or private information

The personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide this information will result in the non-validation of the order.

In accordance with the law “Informatique et Libertés”, the processing of personal information relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL). The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the French law of January 6, 1978). 13 Applicable law

The General Conditions are subject to French law. The competent court in case of dispute will be the one of the defendant’s place of residence or, at the plaintiff’s choice, the place of actual delivery of the Product.

The Website complies with French law, and under no circumstances does BANDIT BANDIT guarantee compliance with local legislation applicable to you when you access the Website from other countries.
